Arbitration and Mediation Act, 2023

The Arbitration and Mediation Act, 2023 is a legislation that consolidates and modernizes the legal framework for arbitration and introduces a comprehensive statutory basis for mediation in the Federal Republic of Nigeria. Enacted to replace the Arbitration and Conciliation Act, Cap A18, LFN 2004, the Act aligns Nigeria’s alternative dispute resolution (ADR) regime with international best practices, including the UNCITRAL Model Law and the Singapore Convention on Mediation.

The Act establishes procedures for both domestic and international arbitration, recognizes third-party funding arrangements, introduces emergency arbitration, and provides for the enforcement of mediated settlement agreements. It further enhances party autonomy, institutional arbitration, and the finality of arbitral awards while ensuring minimal judicial interference.

This legislation is indispensable for legal practitioners, arbitral institutions, corporate counsel, ADR professionals, investors, and all stakeholders involved in dispute resolution and commercial arbitration within and outside Nigeria.
